    Untruthful Traffic Violation (help)

    Hey guys.

    Well I recently got pulled over from a officer that gave me a violation that I believe and KNOW was not the truth. His story did not check out and he was very unprofessional about presenting the violation to myself. I am just wondering what I can do besides disputing the ticket? I asked a series of questions to the officer in which he did not answer and provided only rude statements that insulted my intelligence. I'm also wondering HOW I can go about getting these answers for my defence in court?

    Here is the story:
    I was driving up the street from my house at 5pm. I reached a 4-way stop where no cars were present so I did a rolling stop and proceeded. I admit my fault for this violation. I note, that this was a side street covered with snow and it was raining. My tires are rather poor in these conditions and driving over 3000rpm's is hard without slipping let alone driving fast.
    Anyways, the next intersection was on Hastings street where the hastings street light was green (i was on the intersection street), so i naturally had to slow down, unless I wanted to go into a busy intersection where i would risk getting t-boned and quite possible die as a result.
    Moving on, I slowed down for this intersection and as i was almost stopped (doing 10km/h) the hastings light turned red and the crosswalk went on. No cars were against me, no pedestrians were blockin the path, so i proceeded to go. I suppose that i did not fully stop and i would accept that fault as well.
    Now I proceeded to the other side of the intersection and a police officer turned his lights on and pulled me over.
    As he reached my car he started yelling at me saying remarks like "are you a complete moron?!? I was in pursuit of you for THREE blocks with my sirens and lights on and you failed to pull over. A kid with your lack of experience should not be driving a car like this" At this point, i started question his story as I commited the violation in the previous block and if he was in pursuit of me for 3 blocks, he would have had to been phsycic. I stated that and asked questions with no answer except saying i was an idiot and should have my eyes checked by the ministry.

    In the end I was slapped with 2 failures to stop at a stop sign, which i take fault for. He also gave me a violation for driving without due care or as he stated "reckless driving" FOR going OVER 50km/h through both intersections without braking. He did not clock me because i asked and then took the liberty of assuming i was calling him "mentally handicapped" as he so elequantly put it. I was going 45km/h, no lies, and with the conditions, going faster than that would be hard and without stopping going through hastings would surely have me killed.

    These violations are more than enough to take my N drivers license away although i can get my full license in 6 months. I am disputing the ticket and am banking on getting my full license before the court hearing, but thats another story. My questions are what extra steps I can take to have a hearing in my favour? Any loop holes, actions i can take to have this dismissed? AND HOW can I supply questions to the officer and recieve answers to help defend my case? as he never answered my questions.

    well considering you really unlucky bro.. but its all good.
    those are some serious points on your license so first thing i would suggest is wait 29 days then dispute it. I say 29 days because it takes a month for any violation to show on your driving record i.e they give you a month to Dispute your violation.
    so that means you have 5 more months untill you may go get your class 5
    once you dispute it takes more then a year for a court hearing by then u'll be resting in peace with your class 5 maybe class 1 like me
    oh i got a speeding ticket which was a complete b.s and the cop himself said go dispute it and laughed off anyways i dispute that ticket in march last year and yet no hearing.
    just don't worry about it too much.
    Note: Keep your eyes glued to that Rear View Mirror once you're in that hot seat make it a habbit will save you in long run many times..

    Yeah, I just don't agree with the undue care and attention part. I don't believe a $700 violation was necessary. I just want to have some of my questions answered to have a viable case against the officer, but i don't know how to go about that. As for the rear view, I knew as soon as the lights were put on, its like high beams, couldn't miss it.

    Boy, it really sounded like he had his panties in a bunch. His wife must be pissing him off or something.

    Did he read you your rights with the undo care and attention ticket. From what I understand that violation is part of the criminal code now. The last time I was on the verge of getting one (fell asleep and roled 3 km out of Golden 10 years ago) the Constable read me my rights before he questioned me about what happened.

    Fight the ticket, the worst that can happen is that you get the ticket anyway. The best that can happen is that the guy doesn't show and you walk on all counts. If you have to plead your case stick to the facts don't show any emotion and have a job related reason to keep your license and you should be OK.

    He never read me my rights, I had no idea that he was obligated to.... does that account for anything?

    As for needing the license for work, does that actually work?

    I would look into it. Undo C and A is a serious charge. Needing a license for a job is your only saving grace if the Judge wants to take it away.

    when i said eyes on the rear view means just know whats behind you, I know sometimes its hard to spot an undercover prick but i ran east for 2 years hauling lumber and from that time on i don't feel safe untill i know what kinda vehicle is following me. As for the tickets just dispute em and hope he doesn't show up.. unless you have a lawyer because judges most of the time are on bastards side anyways.
