    Accident with a Out of Province car?

    So.. Almost 2 years ago..

    I hit someone on Highway one, near Ikea.. It was Rush hour it was my fault.. I have no issues with that..

    This person was From Alberta..

    I tapped them with my Front Right Corner, From the my Breif inspection on the side of the road it didnt look to bad.

    It was some guy with his family.
    They were in a hurry, we quickly exchanged info and then he was on his way as he was trying to get back to Calgary that night..

    anyways.. I called him a couple days later, cause i wanted to just see about settling outslde of insurance..

    He was going to get an estimate..

    He never got back to me, so i left it..

    My car was fixed (JDM BMW 7 Series) by myself, then painted. then sold.. (New owner was informed about the accident)

    and i forgot about the whole deal..

    Fast forward to now, I get a message on my phone..

    He's was to get things happening so either i pay him, or he is going to do his claim..

    I haven't talked to him yet..

    However im kinda annoyed he waited 2 years to do this..

    That car I hit him in is long gone.. there is no record of the accident..

    what should i do?

    Im looking for some advice before i talk to him..

    isnt there a time limit you have where you can file the claim?

    i havent found any official sites but i have gathered that there is a 2 yr window to re-open a claim... but i dont know how long you have from the time of the accident until you cant open a claim...

    in quebec it is 3 years from time of accident...

    In Ontario you have 12 months to file a claim. There are a couple of ways you can handle this situation, as far as I see it.

    1 - You can be a nice guy and give him a bit of cash so he leaves you alone, even though the accident happened 2 years ago and there could have been more damage done to his car in the meantime. Who knows, he may have gotten into another accident that is his fault now and doesn't want to make a claim, so he could be getting you to pay for the damage done now.

    2 - You tell him to leave you alone since there is no record of the accident happeneing and 2 years is a bit long to try and settle it...

    When it happened, did it look like there was more than $1500 in damage to both vehicles? I know in Ontario you're supposed to get an accident report from a cop if that's the case.

    It seems like you tried to do the right thing when it first happened and he dropped the ball. I'd lean more towards not paying him, but that's me.

    Why would he wait 2 years to get an appraisal and get back to you?

    I'd be careful about this, the guy probably deemed the damage too minor to repair or whatever at that time, and next thing you know he just had a bigger accident, and he's trying to claim it through you.

    No pictures, no proof of the original damage versus whatever he's going to try and claim.

    Its always better to do the right thing in stuff like this...as long as his damage estimate is reasonable.

    If it's reasonable pay it, if its crazy high ask him to go ahead with the claim...he he he.

    or

    If you get a creepy vibe during the phone call you could ask for a photo of the damage with today's paper in the frame.

    Hopefully his damage estimate is reasonable and this goes away with one simple payment.

    Either way get a signed statement that outlines the details of the payment releasing you from future liability.

    if i were you get him to go through the claim, and get the copy of the claim and damages. that way there is a 3rd party involved. the claim only effects you once its 100% completed, so until then you can settle outside the claim. so get the official info from his insurance company, then if its reasonable pay it, but then you know it gets taken care of properly and he isnt trying to scam you.

    prolly he damaged the same side again and now wants u to pay for it to fix it. My guess is that small damage was cheap to fix but now hes ****** it more so its more expensive and wants u to cop the bill. Id ask for a photo of the damage

    Browny_R31 you are probably correct. and leaving it this long has opened it up completely in this case. if ben says (true or not) that the damage has worsened since the time of the accident then the insurance will not cover it 100%. ya ben, get pics, get him to start the claim. if its all legit, then settle outside of insurance. if its fishy... call him on it...
    also call an icbc place, and ask them what the rules on making a claim are. cause there is a time limit. and im sure he is WAY past it.
    EDIT:
    call dial a claim, they should have some insight into making a claim. they wont know about the alberta insurance, but they should be able to provide some insight... 1-800-910-4222
