  • Shipping and 25 year rule

    I'll be shipping my skyline from Japan in the same container my friend has already arranged for his 1992 Toyota Aristo V. The plan is to have the container land when his Aristo becomes legal. The container will leave Japan around the end of April which should put it into port here around mid-end of June.

    I've heard that the 25 year rule could come into effect as early as this summer. This is probably just a "what if" scenario right now...

    But what if the law were to pass while my car was still in transit?

    Technically it's not in the country, but would have been purchased and shipped out before the law would have come to pass.

    I'm just curious, what do you think would happen? Would customs allow the vehicles as they were purchased and shipped before the date of the law passing, or would the deny entry as they hadn't landed yet?

    when australia changed their rule, those who could prove financial obligations were still allowed to import their vehicles (with some restrictions). it is not clear how it will play out here in canada though.

      Container

      You may want to double check your shipping itinerary calculations. If the container ship leaves Japan at the end of April or the beginning of May, the container could be here as soon as mid May. I have had boats arrive in as little as 17 days when the weather was cooperating. That was a pleasant and welcome surprise.
      However, for yourself, if the car is not legal in Canada until say, early June, you will be faced with having your car seized. Be very careful and leave yourself some wiggle room.

        if they implement the 25 year rule, they will most likely give us a 1 year grace period, so that people with cars already tied up will have a chance to get them here

          I don't think we'll get a one year grace period. We're more likely going to get an announcement on the rule and then a set date when it comes into effect.

          Example in May they change the rule and put out in publications that the change was made and it will come into effect sept 1st. The canadian gov't usually does this kind of thing with rule changes.

          Also customs usually uses the "date of direct shipment to Canada" for things like currency conversions, so you might be able to get shipping delays in that way.

          As a last resort if there is a delay there is always a chance to plead your case and get your Form 1 back dated.

            In the end the gov't will do as they please and if they do kill the 15 yr rule life will go on, and we will find other cars readily available to pour our hearts and wallets into. The Skyline is a great car, but its not the only one. It might be a case of easy come easy go.------------- JZ

              If the car isnt legal to June and theres the chance of it landing in may.. i wouldnt risk that..

              Is the month extra wait worth loosing the car..

                the changes to the rules CAN be made immediately after it's approved. always plan for the worst, so you'll be pleasantly surprised when the worst doesn't happen.

                April 1st is the start of the 2nd agenda, which is the earliest date TC could sign the proposal, then it's publicized in the canadian gazzette, and from there, a 75-day hearing period is set, where the public can voice their opinions. this ends on June 14th, then a privy period is schedualed and after that, it'll be finalized possibly immediately.

                i dont know how long the privy period is, but for now i'd consider june 14th as the day everyone should have their imports in...

                      the one i was look at fell through (worse shape than the dealership let on)

                        Well just to clarify my Skyline is already allowed into the country as it was a September 1991 make, my friends Aristo is the one that wouldn't be legal.

                        I'd get my car either way

                        Thanks for input, I'm more informed now than I was, I was planning on waiting until may to ship my car, but right now it sounds the earlier the better.

                          Keep all your paper work.

                          Customs Canada doesn't have the word "grace" in it's vocabulary. Keep all the paper work from the sale. That would show that your car was purchased before the law took effect. If the shipping arrangments have been made, that documentation should be retained to show that the efforts to have it shipped weren't deliberately delayed. The Aristo that may only be legal after the law takes effect might be an interesting case. I personally wouldn't want to test that case with my own money . Just my 2cents.

                            So......


                            Would this count only for cars that haven't arrived yet but are 15 years or older from the date this law goes in effect?

                            Reason I ask, is if someone crazy decided to buy a R34 and store it in Japan. In another 7 years it would be legal to import with the 15 year rule. So in 7 years they would have sale papers to prove they bought it before the new 25 year rule went into place. Would they still be able to bring it in? Somehow I doubt it.
