  • Urgent help needed!!!

    Here is the situation:

    I had bought a GTR from Peter (ph_motorsports) in Oct 2009. Unfortunately, due to financial situations and personal issues, I was unable to transfer it to my name. And then I had the sad break-up.

    A few months ago, I contacted the MTO to find out if I could still sell this GTR without first transferring it in my name. MTO office confirmed that Yes, I could do it, but I would have to give two bills of sale to the new owner - one that I got from Peter, and one from me to the new owner.

    So I did just that, got the money for the car, and the new owner came, took the car away and I gave him the two bills of sale. Now the new owner lives in Barrie.

    When he went to get the car transferred to his name, the MTO office over there refused to do it, without getting a UVIP from ME (meaning that the UVIP have MY name on it as the registered owner). Although the car is 20 yrs old, they didnt even ask for an appraisal. Now the thing is that I could not give him a UVIP since I never transferred it in my name.

    So now everyone is suffering. The new owner is after me for the papers again that are in MY name and I am looking for someone to help me get a frikkin' appraisal for $300. If I have the appraisal, I can just walk into the MTO office, transfer it in my name and then send him the papers again.

    All I am asking is for local GTRCers to kindly help me. I know people who can get it done for $50 or so and they dont even have to see the car. I need this urgently, because the family of the buyer are acting against me, as according to them, I have sold the car "illegally" to him. I know I did everything according to what was told to me by the MTO Office. Despite me asking the new owner to just come down to Toronto and get this sorted out here, he refused to do so. Now I am stuck here and have nowhere to go.

    I only acted as per the info given to me by the MTO office.

    Can someone please please please help me? I have 5 days to complete this. Have the cash in hand to get it done.

    Im posting it here because people visit this more often and it is kinda off-topic and relates to my personal situation that needs help.

    The thing is that in Ontario, ANY car (not just RHD) that is 20 yrs old MUST be appraised by someone. Im sure some of you have a buddy who can do this for me. Even a car dealer is allowed to do it. All I need is someone to say it is worth $300, because it is a wreck and a bare shell. So if you know a dealer who is a friend, please let me know.

    my mom worked at the DMV i just let her read this bro..gay as that sounds.. they cant do that .. man ..if the guys has the bill of sale from the guy that sold it to you.. if the ownership is signed over and it shows on the back "buyer " then your name, and your signature and yur address. then as long as the new owner has a bill of sale from you saying " I , judasentinel sell my 199+ Nissan skyline VIN: 3993485++ to Peter Pan " then they have to accept it. the bill of sale must also include a price..

      Thanks, man. I appreciate what you said. That is exactly what he has:

      1. He has the ownership of the car, which is signed by the guy who sold it to me, dated Nov 2009. I have signed it too.
      2. He has the bill of sale the guy who sold it (and signed the ownership) to me, gave to me, stating the price and my name and the seller's name.
      3. He also has a bill of sale that I gave him, with my name and his name on it, with a price.

      And he is acting all silly because the MTO offices in Barrie have given him a hard time. Now if his family threatens legal action, what am I to do?

      This is madness.......his father just sent an email saying that I am doing an illegal thing for selling a car that I didnt transfer first in my name. On the MTO website, they do say that if you buy a used car, you have to transfer it in your name within 6 days. But I think this would not apply to cars that require an appraisal (20+ yr old cars). Still this is making me look real bad in their eyes. I pride myself in my character and try to be impeccable. And this is really hurting me.

        bro..easiest and quickest way..meet up with him.. this might hurt but.. go to the DMV with the receipt from the seller to you..transfer it to your name ..pay the taxes...then ..go outside...write a receipt for the new kid saying you sold it too him...that will be the easiest and quickest way...the only reason yu need an appraisal is if u want it in "fit" status..meaning ... u can get trip permits without a safety..but f$ck the guy that bought it off u..f$ck him for being a **** .. so get it and put it in "unfit " status..which will happen without an appraisal..so then write him a bill of sale and call it a night...easist way..then he just has to get the car safetied if he wants to get a trip permit.... any car that was not on the road by the previous owner..and is not safetied when sold..goes in unfit..so its not a big deal bro...sooo pfftttt.

          The rules have changed. even an unfit car that is 20 yrs old or more, has to be appraised. thats what the ministry said. so i will still need the appraisal as they refuse to go with the bill of sale price. thats the new rule in ontario started in 2009 i think.

          so thats why i need to find someone here who has a buddy dealer who can do this for me.

              For passenger and light commercial vehicles (2,200 kilograms and under empty weight) 20 years or older, the retail sales tax is payable on the purchase price, replacement value for insurance purposes, or appraised value, whichever is more.

              If you paid less than the Canadian Red Book value, you can get the vehicle appraised before changing ownership. If the appraisal supports a lower price than the Canadian Red Book, the buyer pays tax based on the higher value.

              An appraisal or insurance document showing the vehicle's value must accompany the bill of sale.

                yes ive read that and it doesnt talk about the appraisal or the 20 yr rule. but still, their office is refusing to register it in my name without an appraisal. what do i do?

                  call the DMV hotline man..ask them some more questions....theyre f$cking dicks at the DMV'S man ...call the direct line there awesome to work with bro...ask them all the questions.

                    I called and they gave me the run-around.....and then they asked me to contact ministry of revenue because this 20 yr appraisal rule has been enacted by them. I called there and they confirmed that YES, every car that is 20 yrs or older, MUST have an appraisal done for it to be registered/transferred to a person. I then went to two MTO offices and they both refused to register it unless I had an appraisal.

                    Now I am stuck........and with no one who has a dealer buddy, I dont know what I can do. I cant take that car back as I have already bought a different car with that money.

                          ya...tell buddy to get it appraised..and put it in his own name..cuz i sold my turbo civic..without ever putting it in my name..n the guy had no problems...soo the whole dual ownership thing shouldnt be a problem...tell new owner to get an appraisal...u didnt do anything illegal..it wont hold up in court dont worry dude..ahaha there jokes

                            Update: I finally got it done.

                            All is well. PHEW!!!

                            Now on to getting the balance of money back from the buyer..........
