  • May have been scammed - What to do?? Help!

    Hi,

    I don't want to release any names or give specifics at the moment as I want to see how this turns out.

    Basically, what happened is this:

    I bought a part (fairly expensive - we'll say 500-1000) from someone on this forum and due to the nature of the part decided it didn't need the extra shipping insurance. I received the part in a timely fashion and well packed. On the outside there was no visible damage and all looked great. However, upon a closer inspection I noticed there did actually seem to be some internal damage to the part. I dismantled to the part and as it turns out it's broken and unusable. NOTE: the part was advertised as "mint".

    Here's the issue:

    I let the seller know what I found and asked him how he wanted to handle it. I also included some pictures. His reply was basically "you understood the risk of shipping it without fully insuring it" and "I don't want to see you stuck.. So let me see what I can do" and "I posted pictures of what you were buying so how do I know the pictures you sent me were the same part.. Maybe you already had a broken one". This was on Monday. I sent him an email back right away comparing his pictures to mine and pointed out that you can just barely make out the broken piece in his pictures (if you know where to look.. no doubt though he could argue saying that’s just how the picture looked).

    Since then I have not received a response and am starting to get worried.

    If it happens that this guy jumps ship on me what are my options? Obviously, you can't just steal money from someone.

    BTW, he used his work email and sent the package from his work.. So I do have that information.

    people are going down hill these days.. I would send him another email.. or 5..

    then might as well post all the details here.. since he doesnt care about the transaction, and we dont want him to burn other people..

      I agree post whatever info you have on this guy so you can save future people. Also if you can find out more about him and you have proof of the transaction you could take him to small claims court but i dont know if its worth it...

        a delete keys takes about 1 sec to press. So those 50 emails you sent umm yea.

        How did you pay? PAYPAL with a credit card? start up a claim. If you paid EMT or pretty much any other way your SOL.

          Oh the risks of buying used... You may need to put this on the public spot light if it doesn't get figured out. Why was he selling it? How did you decide to look for internal damage if the outside looked fine? Anyways, I dont' think it was shipping damage and the seller most likely knew?

            Hey guys,

            Yes, I paid with paypal with a visa. I've never had to put in a claim before... Anyone have any experience with that?

            As for finding the damage I could see some of it from the outside when I flipped it over. Its a part that comes apart with only a few screws.

            If this goes sour I'll be posting pics and point fingers. No worries there.

              There is no need to post pics and point fingers, this is a car enthusiast discussion board, not a place to air your dirty laundry.
              If you paid by PayPal and you feel that you have been wronged, file a claim with them and provide them with the proper information to resolve the situation.
              This will get you your money back. Pointing fingers will only serve to discredit everyone.

                good luck with paypal, it's taken me over 9 weeks and yet have reached a conclusion for my claim. Seller has admitted wrong and Paypal has seen both sides of the story and have acknowledged the details and procedures. Apparently the claim is still "under review".

                Oh bureaucracy...

                  I recently had a claim that was finished in under 3 weeks. If the person you are claiming against admitted fault it would have been done in much shorter than 9 weeks. I'd give them a call if I were you.

                    Wouldn't surprise me if paypal is just taking forever, visa once took 3 months to give me back my own money.

                    And yes it is a car enthusiest forum but it's members also have the right to know who is a shotty seller.

                        At this rate we need credit references and literacy tests to allow membership to this board. Even in the short time I have been here is has gone down hill. Majorly.

                            HA! This is an absolute bull sh1t comment. Being an Admin on this site, I would expect you to have due diligence in having this taken care of. Every other forum I am on, if someone gets scammed the name goes public and unless the member rectifies the situation quickly, they are banned. Nice to see all you care about is collecting your advertising money and **** the members, right?

                            Post his info up. I don't know what's stopping you.
