  • Looking for answers....very important!!

    Hello everyone.

    I havent posted anything here in a while. Things have been quite challenging here for me.

    Yet today, after doing whatever I could, I have decided to put my case before the forum because it relates to GTRC.

    In December, I paid a certain member of GTRC, over $4000 to sell me his GTR without engine, FMIC, and other engine bay stuff. I also paid him $$ for shipping it to me, from, BC< where he lives and runs a performance shop. Out of respect for him at this stage, I am avoiding mentioning his name or that of his shop.

    The agreement was as follows:

    1. I would pay him $4200, for which he would get the GTR ready, minus the engine bay, and ship it to me by the end of Jan 2011.
    2. I would pay him another $500 within a month of receiving the car.
    3. He would send me the car's registration within December 2010, so I could transfer it in my name before the 20 yr rule applied and I had to get it appraised for registration

    It is June 24, 2011, and so far, all I have had from this person is pictures of the car being put together, way back in Feb 2011, and I got the registration signed by him in January. I missed the 20 yr rule avoidance deadline as well.

    Since Feb, there have been maybe 15-20 FACEBOOK message exchanges and that's all. He has constantly been telling me that he would ship the car out and giving me excuses about shipping being way too much, or that he was busy or away from work, sick, etc..

    The ONLY contact information I have for him is either his facebook page, OR the cellphone number of his friend/co-owner of his shop. Even the shop does not seem to have its own landline. And I have sent quite a few text and voice messages on his friend's cell, but have gotten much response.

    2 weeks ago, in agitation, I texted his friend and requested him to ask the guy to give me a straight answer. He replied that the GTR was ready to be shipped out early next week (which was actually LAST week)....and still NOTHING.

    I have not only lost the money, but also stand to lose face, and more than anything, a GTR.

    I would have never put this up here, because I prefer to keep my business to myself unless I am desperately pushed in a corner. And I feel I am. Being in Toronto, out of work, no money, I dont have any resources to go after this guy. It is not that I believe he is a swindler. It is just that its been SIX months.....and he doesnt seem to want to conclude this deal or communicate on a regular basis. I have no clue whether he is a cheat or just lazy or irresponsible, or whether the car is there or he has swindled my money. I would rather give him the benefit of the doubt and respect.......but this has been stretched for far too long.

    I just dont know what to do. I left a voicemail message on his friend's cell that if I dont hear back from the guy, I will have to involve someone else into this. And putting this out here is part of that. I wanted this to be resolved peacefully and on a positive note, but now I dont know anymore.

    I want my money back or the GTR, as he had promised, with the stuff he had committed to.

    Not sure how often he comes here.....but if he reads this, please understand that you left me with no other choice. I will refrain from giving out his or his shop's name for now, in the hope that this post will help him realize that he has given his word and a man's word is his bond.

    Can anyone help me? Ideas? Suggestions? Offer to help twist his arm or do something in BC to make him follow through with his word?

    20yr rule? never heard of this before...(just did some quick reference researching on this 20yr rule thing... and unless your car is an 1988 or earlier it doesnt matter how old it is, it will require etest)

    id start looking into legal action, as there is usually a time limit on such things before you can no longer seek legal action... small claims court should suffice... and if you get the car or your funds returned you can always close the court case as it had been settled out of court.

      Do you have a receipt for the payment you made?

      I agree with Shadao - sounds like you might need to be contacting small claims court in BC. Perhaps the threat of legal action will light a fire under his a**.

          I sent all money to him via EMT, so yes, I have confirmations that he accepted the money and he has also acknowledged receiving the money in his FB messages. I dont think he is actually a bad guy who planned this all along. I believe he messed up along the way and now doesnt know how to follow through with it and is avoiding the conclusion of the deal. And honestly, it is none of my business what he is dealing with.

          How can I file a claim in the BC small claims court while I am in Toronto? I have no means to travel to BC, otherwise I would go there myself. I was hoping that perhaps a GTRCer who is local to him might be able to help me out here, like go to his shop and knock some sense into him. He is in the Kamloops/Kelowna area, so east BC. If a fellow member from that area can be kind enough to talk to him, I would greatly appreciate it. I want this to be resolved in a very civil manner.

            unless you made payments to his business,, I'm sure pretty SOL...
            don't think any small claims court or legal action is going to help you...

              I was just in Kelowna a couple weeks ago and talked to a guy about having a gtr for sale a going to Toronto. Pm me with details maybe I can send out a msg to some locals. I'm not from there but know locals and some shops.

                If he messed up along the way he would've let you know if he was a good seller. Not trying to aound like an arse or anything but I think he took the money and ran considering it has been 6 months.

                  Is he in the Lower Mainland? This is BS... you should have no reason to not say who it is. GTRC beat down crew.

                    Call his local police detachment and give them all the information. They have departments for this kind of stuff (fraud etc.).

                      I had a similar issue with a shop in bc. Lasted 13 months and $26,000. Still dealing with minor issues imneed to fix or replace newly installed parts.

                      There are People out there who accept money to go and "deal" with people like this. Good luck.

                          That's one of the reasons why we all love you, man.....the doing it part, not the intimidating part.

                          I want this to be resolved in a civil manner with no hard feelings on either side. Personally I think the guy is genuine and a good person, but is a bit confused. And I know he is young. He should not have committed to make the deal if he was unable to fulfill his promises. The best solution may not be going the police or court route, but to have a 'friend' from here pay him a visit and ask why he has delayed it so much. Summer is slowly winding down. I wanted to get that car and drive it. And by him delaying it, I cannot put it all together and enjoy my summer in a GTR.

                          Let's see if he responds to a friendly visit from a GTRCer.....without getting offended. And if he does, well, he had ample time to avoid all of this.

                            Hey Munib, if you do get the car in the next little while let me know. We could make a weekend of it and get the car running for you man. Sorry to hear about your troubles man. I'm sure it will be fine man. If I can help with anything shoot me a text or give me a ring

                              you have the registration papers? so legally you own the car?? call the cops and tell them someone stole your GTR and you suspect it to be so and so (the guys name) the cops will find him in possession of your car, and they will return it to you lol... in a perfect world. I dunno if that could work just an idea that popped into my head.
