      So I can walk into court and just say the tint was instlled befor 1993 and if the prosecution can't prove otherwise I'm free?

        I dont think it would be that easy, but it's an argument that could be made. I was just trying to prove a point lol.

        Before going to court, you ALWAYS ask for the full disclosure from the prosecution. They HAVE to provide you with the evidence they will use in court. Reading the officers notes will help you figure out what kind of testimony he will be giving.

        First, under what article of what law is the ticket you received? Do any Regulations apply? Is there any previous case law/jurisprudence on this issue?

        Did the officer take pictures? Did he mesure the tint percentage?

        From what you posted, the regulation specifies PERCENTAGES...how will the judge know your tint is under/over the specified percentage?

        If he didn't mesure it, then it's the subjective perspective of the officer, and courts do not like subjectivity. Unless the officers testifies that the tint is opaque black and that he could not see a thing through it, they have no way of proving that the tinting was higher/lower than said percentage.
        That regulation even gives you a 5% play on the tint.

        They have to be able to show beyond a reasonable doubt that your tinting is non compliant, which would seem pretty hard to do if no mesures were taken.

        You could also give the argument that it was installed prior to 1993. But it would be a little harder to hold up, since you did not own the car back then. In this case it would be up to the judge to find the argument reasonable or not. But I think you'd have to juice it up a little.

          i have 20% all the way around on my car and never had any trouble, and my rear lights are tinted too. good luck with it.

            I don't want to get all legal n crap. but my nismo edition came with stock tint. so some versions on the gtr's do have tint from the factory but not all dude.

              I don't think so. How can you be sure of that ? I have a nismo and it doesn't have tint.

                i always say......best way to avoid tickets is to put your foot to the floor and dont look back....lol

                      No tint is allowed on the driver and passenger windows (front) - I just was pulled over in my Alty by the Sherwood Park RCMP - he showed me in his little black book of traffic laws where it said no tint at all on the fronts - even after he said mine wasn't too bad! mine was 50% fronts 35% rears.

                        If you look at all new vehicles that half rear privacy glass it is not on the front three windows w/s left and right front side windows. there is however tint on glass on factory vehicles that is stated on the glass on one corner, I don't think that any factory glass in North America has sprayon or film tint. I would check to see what guide lines of window tint is at the highest government level the DOT
