would this still override the fact that he lied(assuming he was hiding something)?

if the 'as is where is' thing were true, then all i would have to do is sucker a guy into buying something that is truly something else

Well I work at Toyota and about a month ago we had a young lady come in with a Celica that she had purchased the day before in Edmonton it was making a "odd" noise from the engine bay. We figured out it was rod knock.

Long story short... Seller wrote Car is sold as is, and a few lawyers told her it was no use fighting it and she just had to work it out.

NOW in your case I am sure you can prove it because there is so much overwhelming evidence

Well, because the Documents were part of the sale, you can get him on (or threaten him with):

              - Vehicle Registration Fraud.
              - Vehicle Inspection Fraud.
              - Vehicle Importation/Customs Fraud.

...that should get your money back and your gas money too ! ....lol

While you may not be able to get your money back, he definately commited fraud by tampering with the odo, and giving you false documentation.

Even if you don't get your money back, you should at least have enough to stick a criminal charge.

I had a look at their site. A gtr with 16000km on the odo and selling it for under 13 grand?!!! At that price you should have been more skeptic. If you look more into this, you'll find out that their cars are sold as it is with NO WARRANTY. So they might try to pull a fast one on you "Oh, you bagged the sh*t out of it, so its your fault"

Anything is possible with a heavy foot and oil starvation... I don't but it would take some serious effort to do that kind of damage.

I checked out the car briefly at their lot. The right rear quauter panel was definately damaged and repaired. So, get your money back quickly.
