  • So I bought a lemon

    I read about skyline ownership for close to two years before I actually had the opportunity to go out and buy one. That being said I know all about these cars having problems and costly ones at that. Ok.
    But do I have a lawsuit on my hands?

    Here is my predicament:

    March 22nd - Went to calgary to buy a GTS-t Skyline. OOP was done "In-House" .. He told me doesn't matter how long until I get it registered, he can write up a new one no problem. I had insurance but I did get dinged for the no reg on my way home. My fault. its now registered, duh.

    Dealer/Importer said the car passed OOP without a problem "Nik, This car is in absolute perfect mechanical condition. No problems!"

    I did a light walk around the car listening for anything out of the norm, or to spot anything out of the norm. After he said I was good to go I checked my headlights.. what do ya know, no bulbs and a busted fuse.
    To fix this he took parts off of another gts-t including a headlight harness that he duct tapped together on my car, and the bulbs. Still left with a tail light out.

    March 26th - Car is Parked. Not even 500kms put on the car, including the 300km drive from calgary (I reset my trip distance every time I buy a car), and I am having issues already.
    I posted up my symptoms and a couple people were really good helps. I ran through a lot on my car an now I can have all the IC piping off in two minutes... go me

    I call The importer and he wants me to pay to have my car flatbed to calgary. I told him it would cost me just as much to have someone here fix it, and that I am not pleased less than 500kms into ownership and the car he sold me is ****** up, and a LOT worse than I thought at this time.


    2nd week of April
    - took the car to a fellow members house, and he ran through everything I did to triple check and he found a boost leak from an end tank.

    Ok. Great. Replaced IC... still same problem. Replaced fuel pump twice, Fuel filter, still same problem. Replaced FPR with a nismo adjustable FPR. same problem...
    replaced plugs gapped 1.0 even, replaced maf, replaced coils, replaced tps, igniter.. same effing problem. but I had to be getting closer now

    Check the ECU, was throwing code 55.. oh you bas**** I thought...

    From there the idea of the cat being clogged came to mind so the exhaust was taken off. At that point we realized the exhaust is completely rotted off right before the krappymoto racing exhaust. perfect?

    Also noted the tires are cracked and weathered, some bushings are ******, and inside the gas tank was a thick layer of what seemed to be rust. Thats what caused my issues..

    April 16th
    - Fellow member got my car to somewhat driveable condition for a little while but on the way home the problem came back. f***!!

    April 17th
    - I drive my car down to Calgary, doing 80 the whole way. As soon as I give it any load, car bogs down. yay.
    He told me to bring it to him, Importer said he'll have it fixed and I'll be on my way. Ending up leaving my car there.

    April 22nd
    - I call to check up on my car. Its at his "skyline specialists" and he is looking it over. Great, maybe someone who knows what they're doing.

    The "Specialist" replaced the fuel pump and cleaned out the tank. He said I would have to drive without boost for 150-200 kms to get the rest of the system cleaned and that I wouldn't need to replace anything else.

    At this point I told him there is no way this car passed OOP. Importer/dealership is insulted. So I ran through the list of what it didn't have:
    X - DRL
    X - Side Markers
    X - DOT Healights
    X - Third Brake light
    X - Neutral Safety Switch

    also
    X - Good tires (tread was fine, but they're cracked to heck including the sidewalls) he said it is up to me to get new rubber.
    X - Exhaust (Down pipe is rotted to heck, exhaust rotted right off before the muffler)
    X - bushings are toast
    X - whole rad support is rusted to ****.
    there are other little problems that I forget, but I have two witnesses INCLUDING someone who does OOP.

    I bought the car not knowing all of this. Now he tells me it is up to me to get this done? So now I have to pay for everything to get the car to pass oop even though it clearly didn't when I bought it?

    I am financing the car, does this have an effect on the situation? Now that he knows I KNOW this car didn't pass.
    I want the car. I love the car so much already.

    I just want him to fix his crooked mistakes and wondering if he has to BY LAW.

    What should my next move be?

    uhh... just give him back the pos and get your money back

    skylines are a dime a dozen, there are tons of good ones out there.

    return the car, get your money back, and get a good one.

            then you clearly dont have enough money for one.

            dont buy a cheap pos just so you can have a skyline

            return it

            save your pennies

            find a good one later when you have hte money.

              I don't care about the tools I had to buy. I left mine back home. I needed them anyhow. I also don't care about the supplies I've had to buy, thats just regular stuff. A should have already laying around basis. I don't mind about replacing some of the parts as they are a part of regular maintenance.

              I have a job so paying it off wont take longer than a couple months.

              What is bothering me is the exhaust, the fuel tank, and the tires/bushings.
              would I be being a douche if I wanted him to replace them?
              update: importer is putting on a different exhaust.

                Sounds like you should of inspected the car a little more, or have someone do it.

                It's kind of hard imo to miss a rusted/rotten exhaust.

                All in all, if you feel you can sort things out with the importer then good. The easier route would be to just get a refund and find something else.

                    Not to be a **** or anything like that but is this not the reason you get an independent mechanical inspection prior to buying a car, or at least look under it with your own eyes?

                    Minus the rust i have seen a lot of skylines pass with none of those criteria met, minus the rust which even then should not be reason to fail a car unless it has holes rusted through it.
                    I would attempt to get your money back, a lawsuit will not end in your favor.

                      Was the car sold as is? If this car was less than $4k, that would explain the issues your finding, however, I believe there is a law where if a used vehicle breaks down within a short period of time (or 200km?). I don't know for sure. If you can't get this covered by the company, I hope the cost of the car was low to make up for all the repairs. I'd go after the OOP inspector for passing it if it shouldn't have.

                        I guess I should take it back. Thats a shame, I liked it.

                        I wont be releasing the name of the dealer

                        I honestly thought the car was in better shape. I went over it and didn't notice the tires. I also didnt notice the exhaust because of such an awkward spot where its rotted off, but still held onto the muffler by brackets.

                          If they're willing to fix all the problems for you so it runs propperly, then I'd say great. You might have to wait a bit, and it sucks that you got hosed the first time, but if you can recover it then why not?

                            At that price you should be getting a pretty damn good GTS. Take it back or take em to court.
