Lost license for 3 months

    I don't really care just sucks I brought the Mazda that day instead of the Skyline =[

    I had a speeding ticket last month, I just got home yesterday to a mail from ICBC saying I had to send my license in and the suspension would start once they received it.

    I'll probably just dispute it since aside from 2 speeding tickets, neither of which were anything major, maybe 15 or 20 over the speed limit on a highway, and then this. One of those speeding tickets was from over a year ago too.

    The cop was a prick actually. He made me do 2 different sobriety tests even after the breathalyzer

        The N really doesn't bother me that much other than the people thing. But it was my own idiocy that made me bring a big car to a party I knew people would be drinking at.

          True.

          I say dispute it, then hopefully your class 5 test is soon (less than 6 months) then you can pass, and be good to go.

          10 points maximum is a nice buffer

          Sounds like the officer threw the book at you. RCMP or PoMo officers?

          M_Melen, the reason for the "1 passenger" rule for BC is because of some generation before us that did a lot of street racing in richmond and got killed. They figure: young drivers + many passenger = peer pressure and dangerous driving. I don't mind it, but I'm biased because of class 5 status.

                I usually find RCMP to be the greater of the two evils, but thats just me.

                Dispute the ticket, bring one of your friends to testify and see what happens. Worst comes to worst, you end up paying what you already had to, plus you get 6 months+ to not worry about it.

                With your N, your only allowed 4 penalty points (i believe) and your speeding ticket was probably 3 points. With going over your passenger limit, that would take you over the allotted points, especially if the officer tried to nail you for each passenger, which is a huge **** move.

                What I'm not sure about is the fact that they took your license away. Unless your speeding ticket was over 4 points or you paid for, hence pleaded guilty for driving too many passengers, then they shouldn't take your license away.... Unless driving too many people is an indisputable violation?

                  For class 7, aka "N", if you go over 3 penalty points within the 24 months period, your license is suspended and must be forfeited.

                  Considering he's had a speeding ticket:

                  that's: section 146(3) 3 points.

                  As class 7, you have a few restrictions:

                  1 passenger only (if not family)
                  zero alcohol in system
                  must display N sign at all times

                  If the cop decided to give him:

                  Section 25(15): Drive contrary to restrictions, that's 3 points.

                  You can't be dinged for every other person. 3,6 points etc.. Just 3 points.

                  So he's sitting at 6 points if he pleads guilty. Which means his DPP is going to be $300 a year (lame new rule) and loses his license for 3 months minimum and restarts his 24 months Novice stage again.

                  I say dispute, hopefully your class 5 comes up soon. Then worst case senario, if the judge rules you guilty for the restrictions rule, you would sit at 6 points out of maximum 10 points before losing your license.

                        The 24 Month period only applies to violations that you have pleaded guilty to though. I received 12 points on one ticket and disputed my ticket, still have my license to this day.

                        I'm saying if he pleaded guilty to the speeding violation and has lost his license. He must of A) got more than 3 points from the speeding ticket OR B) pleaded guilty to violating the Class 7 restrictions, in which there is no real point in giving him advice, because the punishment has been served.

                            We have the same system here. our license classes are G1 (learners permit, must drive with someone with min. 4 years licensed driving experience, no highways, and no driving at night), G2 (cant drive out of province, and limit of 1 passenger under 19 that isnt blood-related between midnight-5am for the first six months, and limit of 3 for the remaining time until you move up to a G), and G, which is a full license. From G1-G, it could take as little as 20 months. I recieved my G1 on my 16th birthday, last march, and am eligable for my G this coming november.

                              1) learner's permit (have to be accompanied by an experienced driver)
                              Driving exam:
                              2) probation license (2 years with 4 points and 0 alchool)
                              3) automatic full license after probation is over.

                                Everyone knows Montreal has Canadas Worst Drivers.. (Or so the Stereotype goes)

                                I have no issues with the Graduated Licensing program, that BC has, I went through it.. no issues.. Just follow the rules its pretty simple..
